Outcome:
Because we hold that Miller met his burden of producing clear and specific

evidence of a prima facie case for each essential defamation-per-se element, we

reverse the trial court’s order dismissing that claim. Further, we reverse the trial court’s award of attorney’s fees and sanctions. See id. § 27.009(a)(1),(2). Finally, we remand this matter to the trial court to allow Schupp the opportunity to attempt to establish an affirmative defense or other ground upon which she might be entitled to judgment as a matter of law (i.e., the third step of the TCPA analysis). See id. § 27.005(d).
