The Fair Labor Standards Act (FLSA) is a federal law that sets standards for wages, hours, and child labor for most private and public employees:



Minimum wage



Requires employers to pay covered employees at least the federal minimum wage



Overtime pay



Requires employers to pay covered employees one-and-one-half times their regular rate of pay for hours worked over 40 in a workweek



Child labor



Restricts the hours children under 16 can work and prohibits the employment of children under 18 in certain jobs



Recordkeeping



Requires employers to keep records



The FLSA is administered and enforced by the U.S. Department of Labor's Wage and Hour Division (WHD) for private employment, state and local government employment, and some federal employees. The U.S. Office of Personnel Management enforces the FLSA for other Executive Branch agencies, and the U.S. Congress enforces it for covered employees of the



Legislative Branch.



The FLSA does not require employers to provide notice before terminating or laying off an employee. However, some states may have requirements for employee notification, and the WARN Act may provide for notice in some situations.
