Additional Information: Vicki Johnson is a partner in the trial group practicing in complex commercial litigation, employee benefits and executive compensation litigation, and appellate matters.


A significant portion of Ms. Johnson’s practice is devoted to defending claims involving employee benefits and executive compensation brought against companies and employee benefit plans, including claims brought under ERISA, USERRA and other federal, state and municipal laws. She also counsels clients on fiduciary duties and other related duties including obligations under TABOR. Recently, she was hired to prosecute an appeal of a decision ordering a pension plan to pay certain benefits and successfully argued that the plan could not be required to pay those benefits, creating new law in that area. Over the past five years, she has successfully defended several class and individual actions seeking pension credit for time served in the military.


In addition to her employee benefits and executive compensation practice, Ms. Johnson employs her business and accounting background to represent clients in general commercial litigation matters, including contract disputes and business torts. She has litigated several disputes associated with the dissolution of businesses or disputes among existing business partners, including claims of breach of contract, mismanagement, fraudulent misrepresentation, and breach of fiduciary duties. She also has defended real estate companies and agents with respect to franchise and agency liability, as well as consumer protection claims. As an expert in arbitration law and prolific writer on the subject, Ms. Johnson is often asked to consult on procedures or issues associated with arbitration proceedings.


Prior to joining the firm, she clerked for the Honorable Mary J. Mullarkey, Chief Justice of the Supreme Court of Colorado. Ms. Johnson received her J.D. from the University of Colorado School of Law where she was Editor-in-Chief of the University of Colorado Law Review, and she received her B.S. from Cornell University. Before becoming an attorney, Ms. Johnson worked as an accountant for a software company and later became a software trainer for the same company.


Ms. Johnson is the President of the Colorado Women’s Bar Association. She is a past President of the Thompson G. Marsh Inn of Court. She writes an annual article summarizing changes to the law of alternative dispute resolution, including arbitration law.
