Kelly earned his undergraduate degree with distinction from the University of Nebraska in 1972, and his law degree from Duke University in 1975. After receiving his law degree, Kelly joined one of the then largest firms in the country where he learned from some of the best legal minds in practice. He quickly found his niche in labor law and began working to prevent union organizing, strikes, and other forms of labor unrest at companies throughout the United States.

In 1979, Kelly founded the law firm of Berens & Associates. The firm became Berens & Tate, P.C., when Kelly and long-time friend and mentor, John Tate, joined their practices. Kelly's bold act and well-timed decisions along the way have led to a thriving firm of professionals who are highly experienced in all aspects of management-side labor, employment, and human resources law.

Kelly's experiences have allowed him to work with a wide array of employers, from Fortune 500 companies to single location enterprises, and in locations ranging from small rural communities, to the most cosmopolitan cities in the world.
