Rudy represents clients in a variety of areas including patent counseling and opinions, due diligence, licensing and transactions, interferences, litigation, prosecution and reissue and reexaminations.
He has conducted successful appeals in various intellectual property matters. In one such case before the Supreme Court, Dawson v. Rohm and Haas, 448 U.S. 176 (1980), he established an important exception to the antitrust laws for control of unpatented products under contributory infringement standards. Rudy has conducted intellectual property trials and ADR proceedings before numerous courts throughout the United States including Alabama, Delaware, District of Columbia, Kentucky, New Jersey, North Carolina, Massachusetts, Michigan, Texas, Virginia and Wisconsin involving such technologies as pharmaceuticals, herbicides, medical devices, genetically engineered plants and biological chemicals. He has also acted as an arbitrator/special master in resolving intellectual property disputes.
He is a former Patent Examiner. He is a member of the Delaware, District of Columbia, Federal and Federal Circuit Bar Associations, PIPLA and the American Intellectual Property Law Association. He has previously chaired the Delaware State Bar Association Intellectual Property Section. He is a fellow of the American College of Trial Lawyers.
He has written and lectured extensively on a wide variety of patent, trademark and trade secret matters. He is presently listed in Best Lawyers in America, Euromoney Magazine’s Guide to the World's Leading Patent Law Experts; Who's Who of Patent Lawyers and Chambers USA, America's Leading Lawyers for Business.
He has been designated as one of the top litigators in the State of Delaware by the National Law Journal. One of Rudy’s most recent writings is the chapter on Patent Trials in Patent Litigation Strategies Handbook, published by the ABA Intellectual Property Law Section, BNA Books.
