Mr. Carey has handled class action lawsuits against a number of organizations and companies, including several state lotteries for selling deceptive scratch game tickets; the state of Arizona for grants and tax credits for buyers and dealers of alternative-fuel vehicles; banks for improper fees; insurance companies for not providing statutorily required coverage or notices, charging for coverage they were already obligated to provide, or not paying enough for cars that were worth less after repairs were made; and Hyundai for misrepresenting the horsepower ratings of its cars. In addition to arguing several high-profile cases in various state Supreme Courts and Courts of Appeals, he litigated multi-billion dollar claims by counties for damages stemming from tobacco-related illnesses and more than two dozen consumer, insurance and financial class actions in various states.
Mr. Carey served as judge pro tempore in Maricopa County Superior Court, and as special counsel for Hagens Berman suits on behalf of the States to recover Medicaid and statutory damages in a landmark public health issue.
From 1990 to 1996, Mr. Carey oversaw all major legal, policy, legislative and political issues for the Arizona Attorney General’s office as the First Assistant Attorney General. He was instrumental in several suits, including a $4 billion divestiture, a landmark $165 million antitrust settlement, and numerous consumer and tort cases.
By creating a backward-looking collection model for filing fees, Mr. Carey helped stanch the flood of prisoner litigation plaguing the country in the mid-‘90s. Incorporating his idea in the Federal Prisoner Litigation Reform Act of 1995, sponsored by Senators Bob Dole and Jon Kyl and which he helped draft, has dramatically reduced frivolous prisoner litigation by simply making prisoners pay the same filing fee paid as anyone else and collecting that filing fee whenever funds exist, even if after the fact. This federal program sprung from the Arizona act Mr. Carey drafted, which served as a model for other states’ acts. In addition, Mr. Carey was a principal draftsman for and member of the Arizona Criminal Code Revision Committee and the Victims’ Rights Implementation Committee, and conceived of and spearheaded passage of Arizona’s laws requiring all sex offenders to be DNA tested and instituting a criminal penalty requiring that criminals pay the cost of victims’ rights.
Mr. Carey has also taught tort, contract and public policy courses, most recently at the University of Colorado’s Graduate School of Business, and served as staff member and intern for U.S. Senator (then-Congressman) John McCain on his first campaign and after he was elected.
Mr. Carey graduated with a bachelor’s of science from Arizona State University and earned his law degree and MBA from the University of Denver, studied the law of the European Economic Community at Cambridge University, Cambridge, England, and is an alumnus of the State and Local Government Program at the John F. Kennedy School of Government, Harvard University. The judges of the Superior Court of Arizona in Maricopa County recognized him for outstanding contributions to the justice system, and several groups have invited him to be their keynote speaker at national conferences.
