Stilwell, OK - The State of Oklahoma, ex rel. Department of Transportation sued The Helm Living Trust on an eminent domain theory seeking to acquire by condemnation certain rights, title and interest in real property owned by the defendant for public use.
The Commissioners appointed by the Court awarded the Defendant $16,500.
Both parties demanded a jury trial on the issue of damages.

Under Oklahoma law, the defendant is entitled to attorney fees, expert witness fees and cost due to the fact that the jury verdict was more than 10% greater than the Commissioners' award.
