Description: Tulsa, OK - A personal injury, animal attack lawyer represented Anna Allen, who sued Anna Riddell, Joshua Farley, and Gary and Vanda Starr on negligence, reckless intentional infliction of emotional distress, and wrongful injury to an animal theories. The petition alleged that Mr. and Mrs. Starr owned a house which Anna Riddell and Joshua Farley occupied together with a wolf in the backyard, which had allegedly ripped Ms. Allen's corgi from her fenced backyard and killed the corgi. The pre-trial order walked back the allegation of having a wolf, and referred to it as a canine.
Outcome: Following the plaintiff's presentation of evidence at a bench trial, the Court directed a verdict in favor of the defendants on the punitive damages and emotional distress claims, and the plaintiff dismissed the wrongful injury to an animal claims. Following the defense's presentation of evidence, the judge ruled in favor of the Defendants on the remaining claim for negligence. Defendants have since filed a motion to tax the attorney fees to the plaintiff.
