Oklahoma City, OK - Megan Ruess sued the Oklahoma Department of Transportation claiming that on March 29, 2016, she was injured in an auto backhoe accident on State Highway 105 in Logan County and asserted a claim for damages under the Governmental Tort Claims Act.

Plaintiff claimed that Defendant's employee was improperly and unsafely driving the backhoe on a public roadway in violation of safety regulations and lunged toward the Plaintiff, cutting off Plaintiff's lane of travel and causing her to crash.

Defendant claimed that Plaintiff negligently attempted to pay in a marked work zone, at an unsafe speed in a non-passing zone marked with a double yellow line and that it's employees were not negligent in any way.

Defendant further denied that plaintiff was injured and/or damaged as a result of any negligence on the part of its employees.
