Description: Norman, OK - Jeremy Rodgers sued Leeanne Crain and Allstate Indemnity Company on auto negligence and underinsured motorist theories claiming:
1. On May 2, 2012, there was a collision in Cleveland County, Oklahoma, involving a vehicle driven by Defendant and a vehicle driven by Charles Brown in which Plaintiff was traveling as a passenger.
2. Said collision was caused by Defendant Leeanne Crain's negligence of driving too closely, inattentive driving, and looking at her phone instead of watching the street, causing Plaintiff to suffer damages in excess of $10,000.00.
3. Defendant violated 47 O.S. §11-310 and 47 O.S. §1l-901(a), which is negligence per se, causing Plaintiff to suffer damages as set forth above.
4. In the event Defendant Leeanne Crain was uninsured or underinsured, Defendant Allstate Indemnity Company is also liable for Plaintiff s damages as set forth above.
5. Studies show that while a person who is intoxicated is 7 times more likely to be in a collision, studies also show that a person who is texting or looking at her phone is 23 times more likely to be in a collision.
6. Defendant is also liable for punitive damages in excess of $10,000.00.
WHEREFORE, Plaintiff requests that he be granted judgment against the Defendants in excess of $10,000.00, judgment against Defendant Leeanne Crain for punitive damages in excess of $10,000.00, interest, and costs of this action.
Outcome: Settled for $28,000.00 and dismissed with prejudice.
