Description:

Williams Field Services sued ABB Lummus Global, Inc. on breach of contract and fraud theories claiming that Defendant breached its agreement with Plaintiff to design and build a gas processing plant in the Oklahoma Panhandle. The plant never performed in accordance with the design specification. Williams claimed that ABB Lummus knew that it would not do so and that the plant was plagued with operating problems and suffered from excessive downtime.

Lummus denied wrongdoing.

Outcome: Plaintiff's verdict for $631,000 on the breach of contract claim and $8.1. millon on a claim of deceit by false representation or deceit by concealment.
