Philana Holmes and Humberto Caraballo claimed that their daughter was injured by Chicken Fingers wold to them at a McDonald's. They claimed that Chicken Fingers were too hot for human consumption and burned burned their 4-year-old daughter.
Ms. Holmes purchased the Chicken McNuggets at the drive thru of a McDonald's on August 21, 2019. She handed the Happy Meal to her daughter who suffered a burn to her leg when she dropped one of the McNuggets on her leg.
The Plaintiffs claimed that the McNuggets were "unreasonable danger" when they were sold and, as a direct result, Plaintiff' daughter was injured.
Outcome: Plaintiffs' verdict on the issue of liability only. Plaintiffs' verdict for $15 million. $400,000 for the burn, $400,000 for future damages.
