Description: Muskogee, Oklahoma criminal defense lawyer represented Defendant charged with felony possession of a firearm and ammunition.
Kent Matthew Stapp was convicted of felony possession of a firearm and ammunition in Muskogee Oklahoma federal district court. The conviction came after a two-day trial, where evidence was presented that Stapp had been in possession of a loaded firearm and ammunition despite being a convicted felon.
Stapp, 41, had previously been convicted of a felony drug offense in Oklahoma in 2005. As a result of that conviction, he was prohibited from possessing firearms or ammunition under federal law. In October 2019, Stapp was pulled over by the Muskogee Police Department for a traffic violation. During the traffic stop, officers discovered a loaded 9mm pistol and ammunition in his vehicle.
Stapp was subsequently charged with one count of being a felon in possession of a firearm and ammunition, which carries a maximum sentence of 10 years in prison. The case was prosecuted by Assistant United States Attorney Shannon Henson.
During the trial, the government presented evidence that Stapp had purchased the firearm from an individual in Fort Smith, Arkansas, and had brought it back to Oklahoma. The government also presented evidence that Stapp had posted a photo of himself on social media holding the firearm.
