Muskogee, OK - Chad E. Osterhout, age 46, sued Kendall Morgan and LeFlore County Board of County Commissioners on civil rights violation theories under 42 U.S.C. 1983 claiming that Morgan was assaulted and battered by Morgan while he was standing with his hands raised.

Osterhout's nose and a bone in this forehead was fracture as a result of being him repeatedly with a flashlight.

Despite the beating, Osterhout was not arrested, but he was told to get out of town by Morgan.

Outcome: Plaintiff's verdict for $4 million.
