Gainesville, GA - Patricia Holland, surviving mother of Kip Eugene Holland and Wayne Holland, Administrator of the estate of Kip Eugene Holland, deceased, sued Cypress Insurance Company on a bad faith breach of insurance contract theory claining that the Defendant wrongfully failed to pay death benefits due the plaintiffs for the death of Kip Eugene Holland.

Plaintiffs also sued James Wendell Harper and J.W. Harper Farms on wrongful death auto negligence theories.

This case was filed in the Superior Court of Lumpkin County, SUCV2019000533, and was removed to federal court by the Defendant.

Outcome:
Plaintiff's verdict for $21 million in compensatory damages and $6 million in attorney fees.
