Davis Ellis and two John Does sued Charles "Chuck" Rodrick, II on defamation, false light and intentional infliction of emotional distress theories claiming that Plaintiffs were injured and/or damages they claimed that they suffered as a result of Defendant posting false and harassing information on several sex-offender websites owned by Defendant.

The Plaintiffs claimed that Rodrick, age 55, published information about them that was not true. They accused Defendant of extortion and using his websites to put victims in a false light and invading their privacy and intentionally inflicting emotional distress.

Defendant claimed immunity based on claimed publication of information from another source provided by the Communications Decency Art.
