Anna Baran v. ASRC Federal

Case Number: 1:17-cv-07425-RMB-JS

Judge: Renee Marie Bumb

Court: United States District Court for the District of New Jersey (Mercer County)

Plaintiff's Attorney: Latonya N. Bland-Tull and Robert Hagerty

Defendant's Attorney: William J. Leahy, Alex Joy Laborda Nelson, Greg Harold Greubel

Description:

Camden, NJ - Anna Baran sued ASRC Federal on a personal injury negligence theory claiming that she was defamed when a manager told federal authorities that she threatened to bring a gun to work and shoot three people.

This case was filed in the Superior Court of NJ - Burlington County, BUR-L-53-00015, and was removed to federal court by the Defendant.

Plaintiff worked for Defendant as a software engineer in Moorestown, New Jersey in 2013. She was arrested and subjected to a psychiatric evaluation before she was fired.

ASRC reported the alleged incident to the U.S. Joint Personnal Adjudication System with the result that she lost her security clearance.

She claimed that she was fired in retaliation for her complaints that her supervisor was harassing her because of her Polish ancestry and for her stated intention to file a complaint with the Equal Employment Opportunity Commission.

04/04/2019 73 TEXT ORDER This matter comes before the Court upon the parties' supplemental briefing [Dkt. Nos. 67, 68] regarding Defendant's Renewed Motion for Judgment as a Matter of Law [Dkt. No. 60]. In Plaintiff's Supplemental Brief in Opposition, Plaintiff states that on September 28, 2017, the New Jersey Superior Court for Burlington County issued an Order granting "Plaintiff's motion for reconsideration, reinstating Counts One and Two of Plaintiff's amended complaint.... and denied the balance of Defendants' motion for summary judgment." [Dkt. No. 68, at p.7]. Because the Order, dated September 28, 2017, was entered by the Superior Court after Defendant had already filed its removal papers in federal court, it appears that the Superior Courts Order was never submitted to this Court. It is hereby ORDERED that Plaintiff shall file a copy of the September 28, 2017 Order on the docket within five (5) business days. So Ordered by Judge Renee Marie Bumb on 04/04/2019. (Costigan, Roberta) (Entered: 04/04/2019)

04/04/2019 75 Letter from Plaintiff re: Def motion for remittitur. (BLAND-TULL, LATONYA) (Entered: 04/04/2019)
04/08/2019 76 TEXT ORDER. This matter comes before the Court upon a letter filed by Plaintiffs counsel on April 4, 2019 [Dkt. No. 75], requesting guidance as to whether Plaintiff should file a response in opposition to Defendants alternative request for remittitur, first set forth in Defendants supplemental brief in support of its Rule 50 Motion [Dkt. No. 67]. The Court hereby RESERVES on Defendants alternative motion for a remittitur. If the Court takes this issue under consideration at a later date, the Court will provide Plaintiff with leave to submit a response. At this time, no additional briefing is necessary. So Ordered by Judge Renee Marie Bumb on 4/8/19. (ar1, ) (Entered: 04/08/2019)
