Description: Skycam, LLC sued Actioncam, LLC and Patrick J. Bennett on misappropriation of trade secrets, unfair competition and breach of contract theories claiming that Bennett took information made available to him as an employee of Skycam and provided it to Actioncam to use to develop an aerial video camera system to sell in competition with his former employer's produce. Plaintiff claimed that Bennett breached an agreement with it by disclosing Skycam's proprietary confidential trade secret information about its aerial robotic camera system to Actioncam.
Defendants claimed that the system developed by it was not based on the Skycam system but was based on publicly available information and upon expertise possessed by Bennett that had nothing to do with him former employment at Skycam.
Outcome: Plaintiff's verdict for $594,000 including $519,000 in compensatory damages and $75,000 in punitive damages.
