San Antonio, Texas – Criminal Defense lawyer represented defendant with appealing the trial order granting a motion for warrant.



Frederick O. Silver sought to appeal the trial court’s December 15, 2021 order granting a
motion for warrant pursuant to article 17.19 of the Code of Criminal Procedure. We issued a show
cause order, questioning our jurisdiction over this appeal and directing appellant to respond to our
concerns regarding appealability of the order.
Appellant’s court-appointed attorney states in a response he finds no reason why the court
should not dismiss the appeal for want of jurisdiction. Appellant also filed a pro se response, but
he did not provide any argument or authority on the question of the appealability of the order.

Instead, Appellant states he seeks to appeal a different order: the trial court’s January 7, 2021
contempt order, issued by the trial court after appellant filed his notice of appeal.
This court does not have jurisdiction to review contempt orders by direct appeal. Norman
v. Norman, 692 S.W.2d 655, 655 (Tex. 1985).

Outcome: We therefore dismiss the appeal for lack of jurisdiction.
