Description: Los Angeles, CA - Yvette Diaz sued Los Angeles County on a negligence theory claiming that the coroner's office cremated her newborn daughter's body without her permission, denying that she was deprived of the opportunity of having an open-casket funeral for the baby.
The child died within 24 hours of being born. The State took possession of the remains and as a result of missed communications and other errors the remains were cremated.
Outcome: Plaintiff's verdict for $605,000.00. The jury found that the county violated the law, finding it 55% responsible for the harm Diaz endured, according to the verdict form filed in Los Angeles County Superior Court. But the jury also found that Diaz was 45% at fault and should have been more proactive about getting information.
