Description: Charles R. Diffenderffer sued Vincent S. Serio on a breach of contract theory for failing to pay for Diffenderffer's bill for legal services. Diffenderffer defended Serio in a contract lawsuit with Pasadena-based Morrison Homes LLC from April 2006 until August 2006, when the parties settled. Serio paid Diffenderffer $21,000 but refused to pay the balance Diffenderffer's bill for services rendered.

Serio claimed that he sent a fax to Diffenderffer terminating his services and should not, therefor, have to pay for all the services Diffenderffer claimed to have provided.

Outcome: Plaintiff's verdict for $44,000.00.
