Mark S. Campbell sued Johnston City, Illinois police officers Tony Kendrick and Paul Grear for the injuries that he sustained when he was arrested on an alcohol-related charge claiming the offices violated his civil rights, 42 U.S.c. 1983, by using excessive force. Campbell was arrested on April 9, 2004, after police received a 911 call that he was driving erratically on Illinois 37. Kendrick and Grear subsequently stopped Grear near his home in Johnston City and charged him with reckless driving and illegal transportation of alcohol. Campbell alleged Kendrick shoved him while he was still handcuffed into a wooden door, causing him to fall into the floor. He also claimed that Kendrick shoved him out of a chair.

The officers denied wrongdoing.
