Description:
Products liability claim by 35-year-old Rhea McAllister who suffered a stroke after taking Metabolife 356, a supplement containing ephedra. She claimed that the product manufactured and sold by Metabolife International Inc. was defective and unreasonably danagerous and that it caused the stroke that she suffered in 2002. McAllister bought the dietary supplement in an effort to burn off weight that she had gained and took it for about a month befor suffering the stroke that took away her ability to walk or feed herself.
Matabolife denied that its product was defective or caused the plaintiff's problems.
Outcome: Plaintiff's verdict for $7.46 million with a find that she was contributorily at fault reducting the damage award to $2.7 million when the Texas cap on punitive damages is also applied.
