Case Style: Dr. Richard Angelico v. St. Luke's Hospital, et al.

Case Number: Unknown

Judge: Curtis Joyner

Court: United States District Court for the Eastern District of Pennsylvania

Plaintiff's Attorney: Hnery Siedzidowski, Blue Bell, Pennsylvania

Defendant's Attorney: Edward Mengel, Jr. of White and Williams, LLP, Philadelphia, Pennsylvania and Richard Stevens of Stevens & Johnson, Allentown, Pennsylvania

Description: Tortious interference with prospective economical advantage and anti-trust - Plaintiff claimed that Lehigh Valley Hospital, Easton Hospital and St. Luke's illegally blocked Angelico from practicing heart surgery.

The hospitals claim that Angelico's departure from heart surgery came after Angelico repeatedly mistreated operating-room staff. Plaintiff alleged that the hospitals conspired to force him out of business so they could divide up his lucrative medical practice. He has accused the hospitals of monopolizing the heart surgery market in the Lehigh Valley and violating antitrust laws by restraining trade. He also has accused St. Luke's and Lehigh Valley hospitals of breach of contract by failing to follow their bylaws in the way they reviewed his application, and re-application, for hospital privileges.

Angelico resigned his privileges at St. Luke's in 1994. He then tried but failed to get privileges at the other two defendant hospitpals. When he was unsuccessful, he tried to go back to St. Luke's. Plaintiff also sought removal of information provided to the national database by the defendants. He claimed to have sustained $19 million in damages as a result of the actions of the hospitals.
