Thomas Seymour, Tulsa and Robert Burton, Tulsa, Oklahoma Defendant's Attorney: Assistant United States Attorney Stepehn Preisser, Pensacola, Florida Description: Hyde Amendment Act claim by Gertrude Brady against the United States of America for filing an indictment against her in July 2003 for various crimes, including conspiracy, mail fraud, wire fraud, bank fraud and money laundering. She was added as a defendant in the case originally filed against Bill Bartment, the CEO of CFS. She claimed that the United States Attorney for the Northern District of Oklahoma had agreed not to prosecute Brady for any illegal actions she might have take at CFS in return for her cooperation in the prosecution of Bartman. She claimed that the prosecution violated the agreement and the case was dismissed by the court on February 6, 2004. She filed a motion in March 2003 seeking Hyde Amendment reimbursement for the more than $220,000 in attorney fees and cost that she claimed she incurred as a result of the prosecution. She claimed that the prosecution was "vexatious, frivolous and in bad faith". The Justice Department conceded liability on March 10th.
