Michael Boyle sued Ford Motor Co. and Garden State Engine and Equipment on a products liability theory claiming that he was severely injured when he ran into an 1998 Ford F-800 truck. on Route 46 in Little Falls, New Jersey on January 10, 2002. The claimed that the truck that he hit was defective and unreasonably dangerous because it lacked an "under-ride guard." Plaintiff sustained head and facial injuries including frontal lobe injuries. The surgery to address his injuries required the use of about 40 titanium plates. He continues to suffer double vision, loss of his sense of smell and taste, loss of feeling and cognitive problems.
Ford claimed that the truck chassis manufactured and sold by it to Garden State Engine and Equipment was not defective and complied with all federal motor vehicle safety standards. Garden State manufactured and installed a bed on the chassis including an under-ride guard.
