Ashley, age 54, claimed that she sustained neck and shoulder injuries that created neck pain and chronic headaches that impacted her career as a surgical technician at Baptist Hospital in Lexington, Kentucky. Ashely settled with Akers' carrier for $50,000 and sought additional compensation on an underinsured motorist theory from State Farm. The defenses asserted by State Farm are not available. Outcome: Plaintiff's verdict for $700,000.00 including $31,504 for future medical expenses; $93,156 for lost income; $487,242 for permanent impairment of power to earn money; $25,000 for mental and physical suffering; and $70,000 for future mental and physical suffering.
