Kennedy Simpson of Thompson Miller & Simpson, PLC, Louisville, Kentucky Description: The plaintiffs alleged that midwife, Jacque Reid, negligently ordered Pitocin, a drug used to speed up contractions, and failed to properly monitor it and terminate use of the drug when problems developed in 1998. They claimed that as a direct result Dane Medley, age 6, was deprived of adequate oxygen and suffered an anoxic insult to his brain and was bone with cerebral palsy that caused him to be physically disabled and profoundly retarded. By the time a physician was consulted and decided to deliver the baby by Caesarean section, the baby was permanently harmed. Outcome: Plaintiff's verdict for $6 million with a finding that Ms. Reid was 40% at fault. The plaintiff previously settled with the attending physician and nurse for $1.2 million.
