Description: Defamation - Slander - Plaintiff claimed that defendant slandered him by calling WNNX-FM (99X) and asking DJ Jimmy Baron if he were gay and if he'd had an affirm with Middlebrooks. Wolff had been Middlebrooks boss at software company DP Solutions until shortly before the call to the radio station. Middlebrooks had filed a complaint with their employer alleging that Wolff had made a pass at Middlebooks wife at a company retreat and Wolff's employment with the company had been was fired three days later. Wolff called the radio station the next day and made the defamatory remarks which were heard by Middlebrooks and others.
Wolff claimed that the call and the statements were not malicious and that he was joking. Wolff counterclaimed claiming that Middlebrooks complaint to their employer about making a pass at Middlebrooks' wife was not true.
Outcome: Plaintiff's verdict for $30,000 in compensatory and $250,000 in punitive damages.
