Description:

Thirty construction workers were injured when the roof of the sewage tank upon which they were working in 2002 collapsed under them causing them to fall to the floor of the tank. Martin Garcia suffered brain damage as a result of the fall that he sustained. Others were impaled on metal rebars and suffered various and sundry injuries and damages. The plaintiff asserted negligence, products liability and legal theories. Harsco Corp provided shoring materials used on the tank. DYK, Inc. erected the shoring and scaffolding. David Gowers Engineering and Quality Shoring and Scaffolding were also involved in the construction project.

Outcome: Plaintiffs' verdict for $30 million. Harsco Corp. was found to be 75 at fault and DYK 15% at fault. The balance of the fault was allotted between the other defendants.
