Description: Patrice Lynes sued Riverside Police Brian Quick and Terry Ellefson for violation of her civil rights, intentional infliction of emotional distress and negligence for taking her into custody and holding her for 12 hours on Suspicion of resisting arrest and batter on a peace officer. Officers Quick and Ellefson were called to Kaiser Permanente Riverside to investigate the cause of injuries sustained by Plaintiffs' husband, William Lynes. They believed that Patrice was not being cooperative and was trying to remove evidence to wrongdoing from the hospital. When confronted, she did not cooperate with them and they took her into custody.
The defenses asserted by Defendants are not available other then they claimed to have have probable cause to take her into custody because of her lack of cooperation into their investigation.
Outcome: Defendants' verdict.
