Plaintiff claimed that on or abut September 2014, she, a breast cancer survivor in remission since 2009, signed a MDVIP participation agreement marketed and sold by Defendants, one or more. In order to sell Plaintiff the MDVIP concierge medical serve program, Dr. Franden and MDVIP publicly advertised and held themselves out to be affiliated with the best physicians and hospitals nationwide. The Agreement required Defendants to perform certain services to include a comprehensive physical examination and personalized "first-call" healthcare in exchange for an annual fee of $1,650.00 paid through Dr. Franden's practice to the MDVIP Defendant.

Plaintiff claimed that she did not get what she paid for and as a direct result suffered permanent partial paralysis and will forevermore experience difficulty ambulating and performing normal life functions.
