Description: Tulsa, OK - Angela Wilson, Andrew Mobley II and Leighann Amos sued Saint Francis Hospital, Inc., Saint Francis Health System, and Saint Francis Hospital South, LLC on medical negligence (medical malpractice) theories claiming:
1. Plaintiff Angela Wilson is the legally appointed guardian for her brother, Andrew Mobley, II, an incapacitated adult. The guardian and the ward are residents of Claremore, Rogers County, Oklahoma.
2. Defendants are healthcare providers doing business in Oklahoma.
3. The actions giving rise to this litigation occurred at Saint Francis Hospital South in Tulsa County.
4. As required by 12 O.S. § 19.1, Plaintiff has consulted with a qualified expertm
who has rendered an opinion that Plaintiffs claims are meritorious and
that Defendants committed professional negligence in their treatiiitt of n
Andrew Mobley. See Affidavit of A. Laurie Koller attached hereto as
Exhibit A.
5. The Defendants provided medical care and treatment to Andrew Mobley beginning on September 23, 2013.
6. Defendants, individually and acting through their agents and employees, were negligent in their care and treatment of Andrew Mobley II. Defendants were independently negligent by choosing not to take reasonable steps to ensure patient safety when hiring employees, training employees and supervising employees.
7. Defendants, through their employees, acted in a way that created a situation of respiratory depression in Mr. Mobley. Defendants failed to monitor Mr. Mobley to ensure adequate respiration.
8. Andrew Mobley II sustained permanent brain injury as a direct and proximate cause of the Defendants’ negligence and claims all damages allowed to him by Oklahoma law.
9. Defendants’ actions and/or omissions demonstrate a reckless disregard for the public safety and lives of patients warranting the imposition of punitive damages.
Outcome: Dismissed without prejudice as to Saint Francis Hospital, Inc.
