STATEMENT OF OPERATIVE FACTS
6. Plaintiff incorporates paragraphs 1 through 5 as though stated below verbatim.
7. On July 12, 2012, Plaintiff was involved in a motor vehicle accident when she was exiting the Walgreens parking lot located at the intersection of E. 101St Street and S. Yale Avenue.
8. The accident occurred when Plaintiff was turning northbound onto S. Yale Avenue and Defendant, in an attempt to pass traffic, swerved left of center from the southbound lanes of S. Yale Avenue into the northbound lanes of S. Yale Avenue, and struck Plaintiffs vehicle.
9. Defendant left the scene of the accident in violation of 47 O.S. § 10-102.
CLAIM FOR RELIEF
NEGLIGENCE
10. Plaintiff incorporates paragraphs 1 through 9 as though stated below verbatim.
11. On July 12, 2012, Defendant failed in her duty to exercise due care and operate her motor vehicle in a safe and reasonable manner.
12. As a direct and proximate result of Defendant’s negligent and reckless actions, a motor vehicle accident occurred and Plaintiff sustained personal injuries.
13. As a direct and proximate result of Defendant’s negligence, Plaintiff suffered serious personal injuries, other personal and financial damages, pain and suffering, damage to personal property andlor loss of enjoyment of life, all in an amount in excess of Ten Thousand Dollars ($10,000.00).
PRAYER
WHEREFORE, Plaintiff respectfully requests this Court enter judgment against Defendant and for an award of compensatory damages in an amount in excess of Ten Thousand Dollars ($10,000.00). Plaintiff further requests this Court grant Plaintiff any and all pre-judgment and post-judgment interest on any award of judgment at the current statutorily allowed rate until paid. Finally, Plaintiff requests this Court grant her the expenses and attorney fees properly related to this action, along with all other relief this Court deems just and proper.
