Description: Norman, OK - Statewide Renovation & Supplies, Inc. sued Christopher C. Ryker on a breach of contract theory claiming:

1. The Plaintiff, Statewide Renovation & Supplies, Inc., is an Oklahoma Corporation, doing business in the state of Oklahoma; the Defendant, Christopher C. Ryker, is a resident of Cleveland County, Oklahoma; the cause of action complained of herein arose in Cleveland County, Oklahoma and this Court has proper jurisdiction and venue over the subject matter and parties hereto.
FIRST CAUSE OF ACTION BREACH OF CONTRACT
2. That the Plaintiff entered into a contract with the Defendant to provide labor and material for repairs and renovations to the Defendant's real estate located at 508 S.W. 149th Place, Oklahoma City, Cleveland County, Oklahoma.
3. That the Plaintiff completed the said repairs and renovations and has made demand on the Defendant for payment of the same.
4. That the Defendant has refused and failed to pay such repairs and renovations and is in breach of contract in the amount of $39,435.26, as shown on Invoice No. 5554 which is attached hereto and made a part hereof as Exhibit "A".
SECOND CAUSE OF ACTION UNJUST ENRICHMENT
Plaintiff hereby adopts and realleges the allegations contained in Paragraphs 1- 4 above as though fully set forth hereinbelow and further alleges:
5. That the Defendant's said real property was insured by Nationwide Mutual Fire Insurance Company.
6. That the Defendant is in possession of a supplemental check from Nationwide Mutual Fire Insurance Company in the approximate amount of $17,500.00, which is intended to be used for payment for the said repairs and renovations.
7. Despite demand, the Defendant has failed and refused to deliver the check to the Plaintiff for payment of labor and materials provided and is unjustly enriched in the amount of
$17,500.00.
WHEREFORE, Plaintiff, Statewide Renovation $ Supplies, Inc., prays for Judgment against the Defendant, Christopher C. Ryker, in the amount of $39,435.26, with pre-judgment and post- judgment interest thereon, costs of this action, attorney fees, and for such other, further and different relief whi1.
