Description: COMES NOW the Plaintiff, William Morton, and for her claim and cause of action alleges and states as follows:
I.
William Morton was driving his vehicle westbound on 2Pt Street at its intersection with Lakewood in Tulsa, Oklahoma on June 12, 2012, and had slowed to make a left turn so as to go northbound on Lakewood when the Defendant, Ashley Roepka, negligently drove her vehicle into the rear of William Morton’ vehicle.
II.
As a result of Defendants’ negligence, William Morton was injured, was physically impaired, suffered pain of body and mind, suffered loss of income and inci4rred expenses for medical care and
treatment. I
III.
As a result of Defendants’ negligence, William Morton will continue to be injured, may suffer with his injury in the future, may suffer pain of body and mind, may be physically impaired, may incur
loss of income, may be disfigured, and may incur expenses for medical care and treatment.
IV.
The claims asserted herein were previously asserted in Tulsa County Case Number CJ-2012-3066 which failed otherwise than on the merits on January 23, 2013. This action is timely filed within one year from that date pursuant to 12 O.S. §100.
WHEREFORE, Plaintiff demands judgment against the Defendant in an amount less than the amount required for diversity jurisdiction but in excess of $10,000.00, together with the costs of this action, interest at the statutory rate, and any and all other relief to which Plaintiff may be entitled.

Outcome: Settled for an undisclosed sum and dismissed with prejudice.
