FACTS
5. On September 7, 2013, Plaintiff was lawfully operating her vehicle northbound on N. Pennsylvania Avenue in Oklahoma City, Oklahoma, when her vehicle was struck from behind by a vehicle driven by Defendant, Belinda J. Muttai.
6. As a direct result of the motor vehicle collision of September 7, 2013, Plaintiff, Lindsay L. Deloera was injured, received medical treatment, incurred medical expenses, lost earnings/time from work, suffered physical pain and suffered mental pain.
FIRST CAUSE OF ACTION
NEGLIGENCE
7. Defendant, Belinda J. Muttai, was negligent in the operation of her vehicle on September 7, 2013 and Muttai’s negligence was the sole cause of the motor vehicle collision between her vehicle and the vehicle operated by Plaintiff, Lindsay L. Deloera.
8. Defendant, Belinda J. Muttai’s negligence in the operation of her vehicle proximately caused injuries to Plaintiff, Lindsay L. Deloera.
9. As a direct result of the negligence of Defendant, Belinda J. Muttai, Plaintiff, Lindsay L. Deloera, sustained permanent injury to her body, physical impairment, physical and mental pain, incurred medical expenses and will likely incur medical expenses in the future, lost earnings/time from work and will likely lose earnings/time from work in the future, and has been damaged in an amount in excess of Seventy-Five Thousand Dollars ($75,000.00).
Outcome: Plaintiff's verdict for $12,800.00.
