Description: Tulsa, OK - Penny Sheehan sued Red Robin International, Inc. on a negligence theory claiming:

COMES NOW Plaintiff, and for her claim against Defendant alleges and states as follows:
1. Plaintiff, Penny Sheehan, is a resident of the City of Collinsville, Tulsa County.
2. Defendant, Red Robin International Inc., at all times relevant was foreign for profit businesses, with a store located at 9017 N. 121st E. Avenue, in the City of Owasso, Tulsa County.
3. On September 15, 2014, Plaintiff was lawfully in Defendant’s store as a customer of the Defendant for the purpose of dining. As Penny Sheehan was walking through the store she slipped on a plastic menu insert that had been left on the floor and fell heavily on the floor causing severe bodily injuries.
4. The incident and resulting injuries to Penny Sheehan were caused solely by the negligence of Defendant without any contributory negligence on•. the part of Penny Sheehan.
5. The negligence of Defendant at the above time and place, among other things, consisted of the following
a. Maintaining their store and/or floor area in an unsafe and/or - . negligent manner.
b. Carelessly and negligently permitting and allowing a plastic menu insert to land on and/or to remain on the floor of their store through which Penny Sheehan was walking; rendering the floor unsafe;
c. Carelessly and negligently failing to remove the plastic menu insert;
d. Failing to properly maintain the floors of their store and, particularly, the floor in the area of the accident, in a clean and safe condition for customers using the facilities of the store; and
e. In failing properly and adequately to supervise and oversee the store so as to prevent the collection of items on its floors.
6. Defendant knew or should have known that there was a plastic menu insert, on their floor for a long period of time and was dangerous to persons passing over it.
7. As a result of the Defendant’s negligence, Penny Sheehan incurred and will incur medical expenses, suffered and will suffer physical and mental pain, suffered and will suffer physical impairments and disabilities, and was otherwise injured and damaged, each in the amount in excess of
$75,000.00.
WHEREFORE, Plaintiff prays for judgment against Defendant in an amount in excess of $75,000.00.
