Description: COMES NOW Plaintiff KRISTY GRIFFIN and for her claim against Defendant MIQUEL WAYNE SMITH, alleges and states as follows:
1. This Court has jurisdiction and venue over the cause herein and the parties hereto.
2. On or about March 19, 2012, Plaintiff and Defendant entered into an agreement wherein Defendant agreed to take over payments on a 2003 Harley Davidson Road King of $222.00 a month and to pay insurance at $40.00 a month. The total amount in controversy exceeds
$10,000.00.
3. Defendant has breached this agreement by refusing and failing to make the payments and has further refused to return the motorcycle to Plaintiff.
4. As a consequence of Defendant’s breach of the agreement between Plaintiff and Defendant, Plaintiff has been compelled to seek the services of an attorney to file suit against the Defendant.
WHEREFORE, as a result of Defendant’s breach of his agreement with the Plaintiff, Plaintiff prays for judgment against the Defendant for an amount in excess of TEN THOUSAND DOLLARS ($10,000.00), for attorneys fees, costs and for such other and further relief to which this Court deems Plaintiff is entitled.

Outcome: Default judgment in favor of the Plaintiff for $16,489.31.
