Description: Tulsa, OK - Timothy Hembree sued Judy Kay Reed on a negligence theory claiming:

1 . This Petition is timely re-filed pursuant to 12 Okla. Stat, Ann. § 100.
2. On or around 6 December 2010, Timothy Hembree was driving south on Vancouver
Avenue, near the intersection with 121st Street East, in Tulsa, Tulsa County, State of Oklahoma.
3. Plaintiff went through the intersection of Vancouver Ave and 121st Street East on a green
light.
4. At or around that same time, the Defendant Judy Kay Reed was approaching the same intersection Plaintiff was driving in.
5. Defendant Judy Kay Reed chose not to stop at the red light at the intersection.
6. The two vehicles collided.
7. Defendant did not yield for the traffic signal.
8. The Defendant’s negligence caused the subject collision.
9 The Defendant is liable under the legal doctrine of negligence per s by choosing not
yield from a stop signal at the intersection and other failures to obey the City of Tulsa’s
ordinances and the state of Oklahoma’s rules of the road.
10. As a result of the Defendant’s negligence, the Plaintiff suffered personal injury and
possibly aggravated pre-existing conditions.
11. That as a result of the Defendancs negligence per se, the Plaintiff suffered personal injury
and possibly aggravated pre-existing conditions.
12. That the Plaintiff Timothy Hembree’s personal injuries caused him pain of body and
mind, interrupted his business and caused him to incur expenses for medical attention with
general and special damages totaling a swri in excess of $10,000.
13. Plaintiff complained of low back pain and hip pain and refused treatm it from EMS Plus
at the scene.
