Description: Oklahoma City, OK - Timothy Walker sued Hiawatha Curtis Bruner on an auto negligence theory (car wreck) claiming:

1. Plaintiff Timothy Walker is a resident of Oklahoma County, Oklahoma.
2. Defendant Bruner is a resident of Oklahoma County, Oklahoma.
3. Venue is appropriate in Oklahoma County pursuant to 12 Okla. Stat. § 137 and Okla. Const. Art. 9 § 43.
4. On or about January 20, 2011, in Oklahoma County, Oklahc,ma, Defendant Bruner negligently and recklessly caused the motor vehicle he was operating to ;:ollide with the motor vehicle being operated by Plaintiff.
5. Defendant Bruner was determined to be at fault for the collision b 'f the Oklahoma City Police Department for following too closely and operating his vehicle at a speed that was too fast for the conditions.
6. As a direct and proximate result of Bruner's negligence and recklessness, Plaintiff sustained damages which include but are not limited to:
a. Medical expenses, past and future;
b. Physical pain and suffering, past and future;

c. Mental pain and suffering, past and future;

d. loss of earnings and earning capacity, past and future;

e. Damage to Plaintiff's vehicle;

e. Loss of use of Plaintiff's vehicle;

7. Plaintiff seeks damages from Defendant Bruner in an amount in excess of the amount required for diversity jurisdiction pursuant to Section 1332 of Title 28 of the United State Code.

Outcome: Settled for an undisclosed sum and dismissed with prejudice.
