Description: Tulsa, OK - Art Nathaniel McMillion sued Derrick Deando Crawford on an auto negligence theory claiming:

1. The Plaintiff, Art McMillion, is a resident of the City of Tulsa, Tulsa County, Oklahoma. The Defendant, Derrick Deando Crawford, is a resident of the City of Tulsa, Tulsa County, Oklahoma.
2. That this Court has jurisdiction in the above entitled cause.
3. That on or about March30, 2012, in Tulsa County, Plaintiff was operating his vehicle eastbound on 46st Street near the Hartford Avenue intersection when Defendant, westbound on 46th Street, failed to yield and attempted a left turn resulting in a collision.
4 That the above mentioned collision was caused solely from the negligence of the Defendant in that he failed to yield for traffic, failed to watch where he was going and failed t operate his vehicle in a manner reasonable and proper.
5. As a direct result of the Defendant’s negligence, the Plaintiff was injured and incurred medical bills in treating his injuries.

OFFER TO ALLOW JUDGMENT TO BE TAKEN

COMES NOW the Defendant, Derrick Deando Crawford, by and through his attorney of record, Jon D. Starr, of the law firm of McGivern & Gilliard, Tulsa, Oklahoma, and pursuant to Okia. Stat. tit. 12 § 1101, offers to allow judgment to be taken against him by the Plaintiff in the amount of $9,000.00, exclusive of costs and interest.
If this offer is not accepted in accordance with the statute, and the time limited by the statute, it shall be deemed withdrawn, and shall not be offered as evidence or mentioned at the trial of this matter.

PLAINTIFF'S REQUEST FOR DIRECTED VERDICT IS DENIED. NO MOTIONS BY DEFENDANT. THE JURY IS INSTRUCTED AS TO THE LAW. CLOSING ARGUMENTS ARE MADE. THE SWEARING OF THE BAILIFF IS WAIVED AND AT 2:25 PM THE JURY RETIRES FOR DELIBERATION IN CUSTODY OF THE BAILIFF. AT 3:30 PM THE JURY RETURNS INTO OPEN COURT WITH THEIR VERDICT WHICH IS READ IN OPEN COURT, ORDERED RECORDED AND FILED, AND IS, TO WIT: "WE, THE JURY, IMPANELED AND SWORN IN THE ABOVE ENTITLED CAUSE, DO, UPON OUR OATHS, FIND THE ISSUES IN FAVOR OF THE PLAINTIFF AND FIX THE DOLLAR AMOUNT OF HIS DAMAGES $7,000.00."
