6. Defendant Jane Roe is a nurse and/or technician, whose name is unknown to the plaintiff, who treated Judy Ann Elam during the pertinent times at the OU M dical Center. Defendant Jane Roe was also an employee/agent of defendant OU Medical Center.
7. All of the transactions which give rise to the plaintiffs causes of actic n occurred in Oklahoma County, Oklahoma.

9. Judy Aim Elam was hospitalized at the OU Medical Center from Febn iay 18,2010, through March 26,2010, on which day she died.

10. During the course of the said hospitalization, the defendants, and all o’them,jointly and severally, rendered medical care and treatment to Judy Ann Elam in a negligent ii tanner, below the accepted standard of medical care. Such negligent care and treatment included, bu’ is not limited to, administering chemotherapy to Judy Ann Elan into her spine and brain, throigh a lumbar puncture opening when there were no test results on the spinal fluid and when, in faci there was no malignancy. Such negligent care and treatment also included, but is not limited to, placement of an IV line into Judy Ann Earn’s wrist for purposes of administering chemotherapy rather than use of a P1CC line, resulting in severe infection.

Outcome: JOURNAL ENTRY OF JUDGMENT

Defendant, Dr. Borden’s Special Appearance and Motion to Dismiss came for hearing on October 11, 2013. Appearing for Dr. Borden was Mary Ann Olson; appearing for HCA Health Services was Byron Wilson Knox. Plaintiff did not appear. After considering the pleadings and arguments of counsel, the Court sustained Dr. Borden’s Motion to Dismiss.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the above action against Defendant, Amber Borden, M.D., and Amber Borden, M.D., P.C. is hereby DISMISSED.
