COMES NOW, the Plaintiffs, Marty CuIp and Shelly CuIp, by and through his attorney of record, Chris Harper, Inc., as a cause of action against the Defendant, Randall Hendrick alleges and states the following:
1. That at all times herein mentioned Plaintiffs, Marty and Shelly CuIp, was a resident of Cleveland County, and at all times herein Defendant, Randall Hendrick, was a resident of Cleveland County, and this Court has jurisdiction over this matter.
2. On Porter and Robinson in Norman, Oklahoma, an automobile accident involving the parties herein this action occurred in Oklahoma City, Oklahoma County.
3. That on or about January 20, 2011, in the area of Porter and Robinson, in Norman, Oklahoma, a collision occurred involving a vehicle operated by the Defendant, Randall Hendrick, and a vehicle operated by Marty CuIp and Shelly CuIp was a passenger, Plaintiff’s herein.
4. In the collision described above, Defendant, Randall Hendrick, was careless, reckless, and negligent.
5. That as a direct cause from the negligent acts of the Defendant, Randall Hendrick, the Plaintiff, Marty CuIp, sustained multiple injuries, and has suffered physical pain and suffering, incurred medical cost and other expenses, disfigurement, permanent impairment, recurring pain and suffering, all to her detriment. The related charges are in excess of $75,000.00, for which this Plaintiff, Marty CuIp, prays for a judgment against Defendant, Randall Hendrick.
6. That as a direct cause from the negligent acts of the Defendant, Randall Hendrick, the Plaintiff, Shelly CuIp, sustained multiple injuries, and has suffered physical pain and suffering, incurred medical cost and other expenses, disfigurement, permanent impairment, recurring pain and suffering, all to her detriment. The related charges are in excess of $75,000.00, for which this Plaintiff, Shelly CuIp, prays for a judgment against Defendant, Randall Hendrick.
WHEREFORE, this Plaintiffs, Marty CuIp and Shelly CuIp prays that a judgment against Defendant, Randall Hendrick, be entered for a sum in excess of $75,000.00, along with prejudgment interest, post judgment interest, court cost, attorney fees and any other relief which this Court deems proper.
Outcome: Settled for $2,000 and dismissed with prejudice.
