MOTION TO DISBURSE SETTLEMENT FUNDS

COMES NOW the Plaintiff Shirley White, by and through her attorneys of record, Garrett Law Center, PLLC, and respectfully moves this Court to set a date for hearing to disburse settlement funds recovered from the Defendant. In support of this motion, the Plaintiff states as follows:

1. That the Plaintiff was injured in an automobile accident allegedly caused by the negligence of the Defendant, Brandi Schwarz, who was insured at the time under an automobile liability insurance policy issued by Insurance Company.

2. That the Plaintiff filed this action on January 27, 2012.

3. That the Plaintiff retained Garrett Law Center, PLLC on a forty percent (40%) contingency fee contract ($4,000.00) that shifted to (5O%) if an interpleader action was required plus all case costs ($892.41) to make all claims and effectuate all recoveries resulting from her injuries.

4. That Garrett Law Center, PLLC and Insurance Company have reached a settlement agreement wherein Farmers has agreed to tender $10,000.00 to Plaintiff and Garrett Law Center, PLLC.

5. The following medical providers have outstanding balances for services provided to Plaintiff, although only Structural Rehab and Standridge Clinic have perfected their physician’s liens in Tulsa County:

TOTAL: $8,914.68

6. The Plaintiff requests that this Court distribute the $10,000.00 recovery by disbursing attorney’s fees and costs to Garrett Law Center, PLLC and to the various medical providers for Plaintiffs health care expenses, and disburse the remaining balance, if any, to the Plaintiff for her pain and suffering.

8. All persons or entities with a possible interest in the settlement proceeds known to this Plaintiff have been notified.

WHEREFORE, premises considered, the Plaintiff prays that this Court use its equitable powers in distributing the $10,000.00 among Garrett Law Center, PLLC, among the various medical providers and the Plaintiff.
