Description: Sherri Dawn Smittle, individually and as parent and next friend of Joshua Smittle, a minor, sued The Estate of Barrell Smittle claiming:

1. The Court has jurisdiction over the parties and venue is proper in this Court pursuant to 12 OkIa. Stat. § 139.

2. Sherri Dawn Smittle is the parent of Joshua Smittle with legal capacity to act on behalf of Joshua Smittle,

3. On or about October 16, 2011, Joshua Smittle was a passenger in an aircraft operated by decedent, Darrell Smittle.

4. The aircraft crashed (the “Accident”), causing the death of the pilot and causing severe injury to Joshua Smittle.

5. The injuries to Joshua Smittle were caused by the acts and/or omissions of the pilot.

6. Plaintiff is entitled to recover damages against Defendant for the personal injuries and other damages suffered by Plaintiff as a result of the Accident.

7. Sherri Dawn Smittle, as parent of Joshua Smittle, is entitled to recover the medical expenses she has incurred for the care and treatment of her son as a result of the Accident.

WHEREFORE, Shorn Dawn Smittle, individually and as parent and next friend of Joshua Smittle, a minor, prays for judgment against Defendant for personal injuries and medical expenses in an amount in excess of Seventy-Five Thousand Dollars ($75,000.00), plus costs, interest, and all other relief this Court deems appropriate.

Outcome: Settled for $103201.86 and dismissed with prejudice with the settlement proceeds to be deposited in trust pursuant to 12 O.S. Section 83.
