Description: Rose Marie Carrier sued Shelbi Caitlin Lanham on an auto negligence theory claiming:

1. That on or about May 27, 2011, on a public roadway South Yale Avenue, in Tulsa County, Oklahoma, Defendant, Shelbi Caitlin Lanham, negligently operated a motor vehicle in a manner that caused her to collide with a vehicle being driven by Plaintiff, Rose Marie Carrier.

2. At the time of the accident, the Defendant was distracted by her cell phone in reckless disregard of the safety of the Naintiff and others similarly situated, which makes the Defendant liable for punitive damages.

3. That as a result of the collision caused by the negligence of Defendant, Piaintiff; Rose Marie Carrier, was thrown about the vehicle, suffered personal injuries, was prevented from transacting her business, suffered great pain of body and mind, and incurred expenses for medical attention for said injuries, with general and special damages totaling a sum in excess of $75,000.00.

WHEREFORE, premises considered, Plaintiff, Rose Marie Carrier, demands judgment against Defendant in an amount in excess of $75,000.00, plus court costs, punitive damages prejudgment interest, postj udgment interest, and what other further relief this Court deems equitable and just.

Defendant did not answer.

Outcome: COMES NOW the Plaintiff, Rose Marie Carrier, and dismisses this cause with prejudice to the right of bringing any other future action.
