1 Plaintiff Zachary Weliman (“Wellman”) is an individual residing in Tulsa County,
Oklahoma.
2. Defendant AAA Northern California, Nevada & Utah Insurance Exchanged/b/a AAA
Insurance Company (“AAA Insurance”) is a foreign insurance company licensed to do business in Oklahoma.
3. Defendant Western United Insurance Company d/b/a AAA Insurance Company (“AAA Insurance”) is a foreign insurance company licensed to do business in Oklahoma,
4. AAA Insurance conducts business in Tulsa County, Oklahoma.
5. AAA Insurance has agents in Tulsa County, Oklahoma.
6. Upon information and belief, Defendant Sacha Nix (“Nix”) is a resident of Tulsa County, Oklahoma.
7. Jurisdiction and venue are proper in Tulsa County, Oklahoma.
8. On or around September 6, 2011, Wellman was involved in an automobile accident at approximately the intersection of 9th Street and lola Street in Broken Arrow, Oklahoma.
9. The automobile accident was caused by Nix when she failed to yield and turned left in front of Weliman.
10, The accident was caused solely by the negligence of Nix, and Wellman was free from negligence.
11. At the time of the accident, there was no liability coverage in effect for the motor vehicle Nix was operating.
First Cause of Action - Ne2lipence
For his first cause of action, Wellman incorporates the allegations contained in paragraphs 1-il herein, and further states:
12. At the time of the accident, Nix was operating a motor vehicle negligently and in reckless disregard for the safety of others in violation of state statutes and city ordinances, and caused a collision with Wellman’s vehicle.
13. Nix was negligent in the operation of her vehicle in that:
a. Nix breached her duty to use ordinary care to prevent injury to others;
b. Nix failed to keep a proper lookout;
c. Nix drove carelessly;
d. Nix was inattentive;
e. Nix was negligent per se;
f. Nix was grossly negligent.
14. Nix’s negligence was the sole and proximate cause of the accident.
15. As a result of the negligence of Nix, Wellman suffered severe serious, permanent injuries, has incurred and will continue to incur medical expenses, has lost income in the past and will lose income in the future, has been permanently disfigured and has suffered in the past and will continue to suffer in the future great pain of body and mind.
16. Wellman is entitled to judgment against Nix in excess of $75,000, exclusive of interest and costs, and an award of punitive damages to deter Nix from engaging in such reckless, grossly negligent, and life-threatening conduct in the future and to apprize the public at large that society does not condone such actions.
Second Cause of Action - Breach of Contract
For his second cause of action, Wellman incorporates the allegations contained in paragraphs 1-16 herein and further states:
17. At the time of the accident, Wellman was listed as a named insured on automobile liability policy no. OKS-D03001604 issued by AAA Insurance (the “Policy”). Wellman had paid all premiums due under the Policy and the Policy was in effect at the time of the Accident. The Policy contained uninsured/underinsured motorist coverage and also medical payments coverage.
18. AAA Insurance has refused to provide coverage to Wellman for underinsured motorist benefits and medical payments as it is obligated to do under the Policy and Oklahoma law.
19. AAA Insurance is in breach of its obligations under the Policy and Oklahoma law.
20. As a result of AAA Insurance’s breach, Weilman has incurred damages in excess of
$75,000.00, exclusive of interest and costs.
Third Cause of Action - Breach of Duty to Act Fairly and in Good Faith
For his third cause of action, Wellman incorporates the allegations contained in paragraphs 1-20 herein and further states:
21. Wellman made claims for underinsured motorist coverage and medical payments under the Policy for injuries he suffered in the Accident. Weliman attempted to negotiate with AAA Insurance’s claims representative concerning payment of underinsured motorist coverage and medical payments.
22. AAA Insurance’s claims representative refused to negotiate in good faith and, on November 2, 2011, AAA Insurance denied Weliman’s claims for underinsured motorist coverage and medical payments even after having notice that Nix did not have liability insurance.
23. AAA Insurance by and through its claims representative refused to accept Wellman’ s claim for underinsured motorist coverage and medical payments.
24. AAA Insurance refused to consider the nature and extent of Wellman’s loss and specifically rejected the opportunity to consider and evaluate WeIlman’s loss,
25. By virtue of the Policy, AAA Insurance owed Wellman an implied-in-law duty to act fairly and in good faith in order not to deprive Wellman of the benefits of the Policy.
26. AAA Insurance actedwillflilly, fraudulently, intentionally, and in bad faith in refusing to consider the nature and extent of Wellman’s loss and in rejecting Wellman’s claim. This was done knowingly, intentionally, and with purpose of discouraging, or reducing, the payment due Wellman under the terms of the Policy.
27. AAA Insurance had no legitimate or arguable reason for refusing to pay Weliman ‘S valid claim.
28. AAA Insurance’s intentional refusal to pay Weilman’s valid claim was a breach of the implied-in-law duty of good faith and fair dealing and operated unreasonably to deprive Wellman of the benefits of the Policy.
29. AAA Insurance’s conduct in intentionally refusing to pay Wellman’ s valid claim was malicious, fraudulent, oppressive, and otherwise reflected a conscious disregard of Wellman’s rights.
30. In refusing to reasonably and timely compensate Wellman for the damage, AAA Insurance breached its obligation to timely fulfill its obligations under the Policy.
31. AAA Insurance refused to deal with Wellman in good faith and fair dealing and in so doing, breached the AAA Insurance implied covenants of good faith and fair dealing.
32. As a result of AAA Insurance’s breach, Wellman has suffered actual damages in excess of $75,000.00, exclusive of interest and costs.
33. AAA Insurance’s bad faith refusal to pay a reasonable amount was wilful, wanton, intentional, malicious and in reckless disregard to its duty to deal fairly and in good faith with Wellman and, therefore, Weliman is entitled to punitive damages in excess of $75,000.00.
