Description: COMES NOW Plaintiffs, Michelle D. Simpson and Brandon S. Simpson, hereinafter referred to as Plaintiffs, by and through their Attorney, Verner W. Hayhurstjr of Vemer Hayhurst Law, and for their causes of action against Defendant Ashley M. Murdock, state and aver as follows:
FIRST CAUSE OF ACTION
1. Plaintiffs are residents of Noble, Cleveland County, Oklahoma and are married.
2. That the Defendant, Ashley M. Murdock, is a resident of Blanchard, Oklahoma.
3. On January 11,2010 Plaintiff Michelle D. Simpson was southbound on 12th Avenue Northeast in Norman, Cleveland County when she was injured in an automobile collision caused by the negligence and/or violation of the laws of Oklahoma by Ashley M. Murdock.
4. As a direct and proximate result of Defendant’s negligence and/or violation of the laws of the State of Oklahoma, Plaintiff Michelle D. Simpson has suffered personal bodily injuries which will include past and future medical expenses, past and future physical and mental pain and suffering and inability to lead a normal life, past and future loss of enjoyment of life, past, present and future loss of earnings and earning capacity.
5. The personal bodily injuries suffered by Plaintiff Michelle D. Simpson were the direct and proximate result of the negligence, carelessness, fliults and omissions of the Defendant.
6. The aforementioned incident occurred in Cleveland County, Oklahoma, and therefore, this Court has full jurisdiction and venue of all matters herein.
7. Plaintiff Brandon S. Simpson adopts and re-pleads the foregoing allegations and further alleges that Defendant’s Ashley M. Murdoek’s actions and conduct resulted in loss of consortium, companionship and society.
WHEREFORE, Plaintiff’s pray judgment against the Defendant Ashley M. Murdock, for actual damages in an amount in excess of $75,000.00, together with attorney fees, costs, interest as allowed by law and other relief as the Court may see fit
Outcome: COME NOW Michelle D. Simpson and Brandon S. Simpson, Plaintiffs in the above- styled matter, by and through Attorney Verner W. Hayhurst jr, DISMISSING, WITH PREJUDICE, the above-styled matter. This dismissal is in conjunction with the RELEASE AND INDEMNITY AGREEMENT executed by Michelle D. Simpson and Brandon S. Simpson in this matter and said dismissal is predicated on the implementation of REFERENCED RELEASE AND INDEMNITY AGREEMENT.
