Description: COMES NOW the Plaintiff, Jose Rickman, by and through his attorney of record, Scoff D. Keith, and for his Petition for Automobile Negligence alleges and states the following, to-wit:
1. That the Plaintiff, lose Pickman and Defendant, Brian Howes are residents of Tulsa County, Oklahoma. The Defendant Donelson Brothers Enterprizes, LLC cl/b/a Donelson Cum Homes is a domestic limited liability company doing business in the State of Oklahoma an&he Defendant Donelson Construction Co., LLC d/b/a Donelson Custom Homes is a foreign limited liability company doing business in the State of Oklahoma. All acts complained of herein occurred in Tulsa County, Oklahoma and at the time of the accident the Defendant Brian Howes wean employee of Donelson Custom Homes and was acting as an agent and within the scope of his employment with the Defendants. Therefore, by theory of respondeat superior, the Defendant Doneison Brothers Enterprizes, LLC d/b/a Donelson Custom Homes and Donelson Construction Co, LLC d/b/a Donelson Custom Homes are responsible for the negligent acts of its employee, Defendant Brian Howes.
2. That the Court has jurisdiction over this matter and that on or about the 4th day of May, 2010, on southbound Sheridan Road, south of East 51st St. in Tulsa County, Oklahoma, Defendant Brian Howes negligently operated his motor vehicle, causing a collision with the Plaintiff.
3. As a result of the actions of the Defendant, Brian Howes, Plaintiff suffered pain, bodily expenses, expenses for medical treatment, lost wages, and other economic losses for which the Defendants are liable.
WHEREFORE, premises considered, the Plaintiff prays for judgment against the Defendants Brian Howes, Donelson Brothers Enterprizes, LLC d/b/a Donelson Custom Homes and Donelson Construction Co., LLC d!b/a Donelson Custom Homes in an amount in excess of Seventy-Five Thousand Dollars ($75,000.00), interest as required by law, costs of this action, and such further relief this Court deems just and proper.
Defendants did not file answers.
Outcome: Settled and dismissed with prejudice.
